SiteMagic — Terms of Service
By using SiteMagic, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the service.
1. What SiteMagic is
SiteMagic is a website building service operated through the Telegram messaging app. You chat with our assistant (@SiteMagicBot), describe your business, send photos, and we generate a website for you. You can request changes, preview them, and publish the site to a domain.
The service is intended for small business informational websites (e.g. service businesses, shops, professionals). It is not intended for e-commerce stores, booking platforms, applications, or any system that processes payments, sensitive personal data, or content subject to special regulation (such as healthcare, financial services, or content directed at children).
2. Who can use SiteMagic
You must:
- Be at least 18 years old, or have permission from a parent or legal guardian.
- Have the legal right to operate the business you are building a site for.
- Have the right to use any photos, text, logos, or other content you send us.
3. How you use SiteMagic
SiteMagic has no dashboard, no login, and no password. Your identity is your Telegram account. Anyone with access to your Telegram account can use SiteMagic on your behalf, so please keep your Telegram account secure.
If you lose access to your Telegram account, contact us at team@sitemagic.co and we will work with you to restore access to your sites.
4. Plans and payment
We offer the following plans:

Paid plans are billed monthly through Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring monthly basis until you cancel. Prices are in US dollars and exclude any sales tax, VAT, or other taxes that may apply in your jurisdiction. Where required, applicable taxes will be added at checkout.
We may change pricing in the future. If we do, we will give you at least 30 days' notice before the change applies to your subscription.
5. Cancellation and refunds
You can cancel your subscription at any time through the Stripe customer portal (we will send you a link in chat) or by asking the assistant. After cancellation:
- Your subscription remains active until the end of the current billing period.
- Your site stops being published at the end of that period.
- We retain your site data and conversation history for 90 days in case you reactivate. Financial transaction records may be kept longer where required by tax or accounting law.
Refunds. Subscriptions are non-refundable as a general rule. Before paying, every customer can use the Free tier to chat with the assistant and generate a preview website at no cost — this is specifically designed so you can evaluate the service in full before any payment.
That said, we may, at our sole discretion, issue a refund in exceptional circumstances. If you are genuinely unhappy with the service, contact us at team@sitemagic.co and we will work something out.
6. Your content
You own your content. Photos, text, business information, and any other material you send us remains your property. By sending it to us, you give us a license to:
- Store it in our systems and on our hosting and infrastructure providers (currently Supabase and Netlify).
- Display it on the website we build for you.
- Process it through AI services (currently Claude by Anthropic) to generate and modify your site.
You are responsible for making sure you have the right to use everything you send us. Do not send us photos, text, or logos that belong to someone else without permission.
7. Data processing on your behalf (Data Processing Agreement)
If you publish a website through SiteMagic, we process personal information that belongs to you or flows through your site — the information you place on the site (e.g. your business contact details, team-member names, photographs), and the page-view records we collect from visitors to your site (described in Section 8 of our Privacy Policy).
For that information you are the data controller and SiteMagic is a data processor acting on your behalf under Article 28 of the EU General Data Protection Regulation ("GDPR") and equivalent provisions of the UK Data Protection Act 2018 and comparable laws. This Section 7 is the data processing agreement ("DPA") between you and SiteMagic. By accepting these Terms, you accept this DPA.
7.1 Scope of the processing
- Subject matter: provision of the SiteMagic service — building, hosting, and operating your website.
- Duration: for as long as your SiteMagic account is active, plus the 90-day retention period described in Section 5.
- Nature and purpose: storage, display, and delivery of your website content; collection and storage of visitor page-view records; AI-assisted generation and editing of site content on your instructions.
- Categories of personal data: business contact details you place on the site (name, address, phone, email); any other personal data you choose to include (team-member names, photographs, testimonials); visitor page-view records (page visited, referring URL, screen width, timestamp, site identifier — we do not collect IP addresses, cookies, or device identifiers on your site).
- Categories of data subjects: your customers, site visitors, members of your staff whom you choose to feature on the site.
7.2 Our obligations as processor
We will:
- process personal data only on your documented instructions, including as set out in these Terms and any additional instructions you send us in the course of running your site;
- ensure that our personnel authorized to process personal data are under an obligation of confidentiality;
- maintain technical and organizational security measures appropriate to the risk (see Section 10 of our Privacy Policy for the current measures);
- assist you, where reasonably possible, in responding to requests from data subjects exercising their rights under applicable data protection law;
- notify you without undue delay — and within 72 hours wherever practicable — after becoming aware of a personal data breach affecting data processed on your behalf, and give you the information you reasonably need to meet your own notification obligations;
- make available to you the information necessary to demonstrate compliance with this Section 7, and allow for and contribute to audits conducted by you or a mandated auditor, subject to reasonable notice, confidentiality safeguards, and cost allocation for audits going beyond our standard compliance reporting.
7.3 Sub-processors
We use the following sub-processors to perform parts of the service on our behalf. At the date of these Terms:
- Supabase — database and file storage
- Netlify — website hosting and content delivery
- Anthropic — AI text and design generation (Claude API, commercial terms, no training on submitted data)
- Stripe — subscription billing and payment processing
- DigitalOcean — server infrastructure for the bot
- Google — Places API, used only to enrich your site when you share a Google Maps link
- Namecheap — domain registration (Premium plan only, at your request)
The live operational list is maintained in Section 5 of our Privacy Policy. By accepting these Terms, you give general authorization for our use of these sub-processors. We impose data-protection obligations on each sub-processor substantially equivalent to those in this Section 7.
If we add or replace a sub-processor, we will update the Privacy Policy and notify you through Telegram. You may object on reasonable data-protection grounds within 30 days; if we cannot address your objection, you may cancel your subscription and we will refund any unused portion of the current billing period.
7.4 International transfers
Odyssean LLC is based in the United States. Most of our sub-processors store and process data in the United States. Where the transfer of your data outside your country of residence requires a legal mechanism (for example, transfers from the European Economic Area, the United Kingdom, or Switzerland), we rely on the Standard Contractual Clauses approved by the European Commission — and, for UK transfers, the UK International Data Transfer Addendum — through our agreements with each sub-processor.
7.5 Return or deletion on termination
At the end of the retention period described in Section 5, we will delete the personal data we processed on your behalf, unless applicable law requires us to retain it (for example, financial transaction records for tax purposes). Before deletion, you may ask us for a copy of your site files and business data at no cost; we will provide them in a commonly used, machine-readable format.
7.6 Order of precedence
If there is a conflict between this Section 7 and any other part of these Terms in relation to the processing of personal data of which you are the controller, this Section 7 prevails.
8. The website we build for you
You own the website. When we generate HTML, images, and other site assets for your business, that content belongs to you. If you cancel or want to leave SiteMagic, you can ask us for a copy of your site files, and we will provide them at no cost.
About AI-generated content. SiteMagic uses AI to write text, generate images (on Pro and Premium plans), and design your site. AI can make mistakes — it may misunderstand your business, generate inaccurate descriptions, or produce text that does not fit your tone. Every change goes to a preview first, and you are responsible for reviewing and approving the site before it goes live. Once you tell us to publish, you are confirming the content is accurate and ready.
We do not guarantee that AI-generated content is unique or that it will not resemble content elsewhere on the internet. If you spot anything that looks copied, problematic, or wrong, tell us and we will fix it.
9. Domains
- Custom domains (Pro): You buy and own your domain. We help you connect it to your site. If you leave SiteMagic, the domain stays with you — we will release any DNS records and provide whatever you need to point it elsewhere.
- We-handle-domains (Premium): We register the domain on your behalf. You are still the owner, and if you ever want to leave, we will transfer the domain to you at no cost. We do not hold domains hostage.
- Subdomains (Basic): Sites on
*.sitemagic.coare hosted on infrastructure we own. If you cancel, the subdomain becomes available again. You can take your site files with you, but the subdomain itself does not transfer.
10. Acceptable use
You agree not to use SiteMagic to build websites that:
- Promote illegal activity, violence, hate speech, or harassment.
- Sell or advertise illegal goods, weapons, drugs, or counterfeit products.
- Contain sexually explicit material, content that exploits or endangers minors, or any other content prohibited by applicable law.
- Infringe on anyone's copyright, trademark, or other intellectual property.
- Attempt to deceive visitors (for example, impersonating another business, fake contact details, or fraudulent claims).
- Distribute malware, run phishing schemes, or compromise the security of others.
You also agree not to:
- Abuse the assistant (for example, send automated spam, attempt to extract our system prompts, or attempt to access other customers' data).
- Resell SiteMagic as your own service without our written permission.
- Interfere with our infrastructure or other customers' use of the service.
If you violate this section, we may suspend or terminate your account without refund and remove your published site.
11. Reporting illegal content or abuse
If you believe that a website hosted by SiteMagic, or the SiteMagic service itself, is being used in violation of these Terms or of applicable law — for example copyright or trademark infringement, fraud, unlawful hate speech, malware distribution, or content exploiting minors — you can report it to us.
Send reports to team@sitemagic.co with:
- the URL of the site or page concerned;
- a clear description of what you believe is illegal or in breach of our Terms;
- enough contact information for us to reply to you if we need clarification.
We review every substantiated report. When we agree the content violates these Terms or applicable law, we act — typically by asking the customer to correct it, removing specific content, or suspending the site. We will reply to the reporter with the outcome where practicable, and we keep a record of reports and actions taken.
This email address also serves as our single point of contact for Member State authorities, the European Commission, and the European Board for Digital Services under Article 11 of Regulation (EU) 2022/2065 (the Digital Services Act). Communications to this address can be submitted in English.
12. Service availability
We aim to keep SiteMagic available 24/7, but we do not guarantee uninterrupted service. The service depends on third parties we do not control, including:
- Telegram — for all customer communication
- Netlify — for hosting your published site
- Supabase — for storing your data
- Anthropic (Claude) — for AI generation
- Stripe — for payments
If any of these services go down, parts of SiteMagic may be unavailable. We will do our best to communicate and recover, but we are not liable for downtime caused by third parties.
We may perform maintenance, updates, or changes that temporarily affect the service. We will try to minimize disruption.
13. Termination
You can stop using SiteMagic at any time by cancelling your subscription and/or asking us to delete your account.
We may suspend or terminate your account if:
- You violate these Terms (especially the Acceptable Use section).
- You fail to pay for your subscription.
- We are required to do so by law.
- We discontinue the service. If we do, we will give you at least 60 days' notice and help you export your site.
On termination, we will stop publishing your site. You can request a copy of your data and site files for 90 days after termination.
14. Disclaimers
SiteMagic is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties — express or implied — about the service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee:
- That the website we build will achieve any specific business outcome (more visitors, more customers, higher rankings on Google, etc.).
- That AI-generated content will be perfectly accurate, unique, or free of errors.
- That the service will be uninterrupted or error-free.
You use SiteMagic at your own risk. You are responsible for reviewing every site before it goes live and for the accuracy of all information published on it.
15. Limitation of liability
To the maximum extent permitted by law, SiteMagic and its operators are not liable for:
- Indirect, incidental, consequential, or punitive damages.
- Lost profits, lost data, or business interruption.
- Damages caused by third-party services (Telegram, Netlify, Stripe, Anthropic, etc.).
- Damages caused by content you provided to us or approved for publication.
Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim arose, or USD $100, whichever is greater.
Some jurisdictions do not allow some of these limitations. In those cases, the limitations apply to the fullest extent permitted by local law.
16. Local consumer rights
If you are a consumer located in the European Union, the United Kingdom, or another jurisdiction whose laws grant you rights that cannot be waived by contract (for example, a statutory withdrawal period for digital services, or specific warranty rights under consumer protection law), those local rights still apply to you regardless of anything in these Terms. Nothing in these Terms is intended to limit consumer rights that you cannot waive under applicable local law.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through Telegram and/or by updating the "Effective date" at the top of this document. Continued use of SiteMagic after the changes take effect means you accept the new Terms. If you do not agree, you can cancel your subscription.
18. Governing law and disputes
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law principles. Subject to Section 16 (Local Consumer Rights), any dispute arising out of or related to these Terms or the service will be resolved exclusively in the state or federal courts located in Washington State, and you consent to the personal jurisdiction of those courts.
